APPLICANT PRIVACY NOTICE (Global Version)

This notice is intended to provide information regarding the use of your personal data by XPO for the purposes of the application process.

 

  1. WHO COLLECTS THE INFORMATION

XPO, Inc, Five American Lane, Greenwich, CT 06831, USA (‘Company’) is the ‘data controller’ of this processing activity. This information is also used by our affiliated entities and group companies, (our ‘group companies’)  mainly those that post job offers but potentially others depending on your profile language skills and country preferences and so, in this notice, references to ‘we’ or ‘us’ mean the Company and our group companies. The Job offer posted will contain information about the group company making the offer.

 

  1. LEGAL BASIS AND PURPOSE FOR PROCESSING

We are processing data for the purpose of processing your application.

The legal basis for processing is your consent.

We will notify you of any changes to information we collect or to the purposes for which we collect and process it.

 

  1. WITH WHOM WE MAY SHARE THE INFORMATION

We may need to share some of the below categories of personal information with other parties, such as in-house recruiters, Hiring Managers, our HR department, other group companies (mainly those that post job offers but potentially others depending on your profile language skills and country preferences); and third party service providers, including recruiting agencies and IT system providers.

 

  1. WHAT INFORMATION DO WE COLLECT?

We receive information about you from a number of sources. Some information is collected with the Applicant Tracking System. We use a third party vendor to host and manage this system in accordance with the requirements of this Policy.

The information we receive and store may include as follows:

  • Your name and contact details (i.e. address, home and mobile phone numbers, email address);
  • Your curriculum vitae / resume;
  • Details of your qualifications, experience, employment history (including job titles potential salary level and working hours) and interests; and
  • Details of your referees.

We may collect the following information after the shortlisting stage, and before making a final decision to recruit, to the extent permitted by the law of the country of the group company making the job offer or recruitment process:

  • Information about your previous academic and/or employment history, including details of any conduct, grievance or performance issues, appraisals, time and attendance, from references obtained about you from previous employers and/or education providers; and
  • Information regarding your academic and professional qualifications.

 

  1. WHERE INFORMATION MAY BE HELD

Information is stored in the USA and accessed by the Company in the USA and in its other group companies at international locations including the European Economic Area (EEA), the United Kingdom (UK) and India and may also be held at the offices of our group companies who are posting the job offer, and third party agencies, service providers, representatives and agents as described above.

 

  1. INTERNATIONAL TRANSFERS

Given that XPO Group companies are located and provide services all over the world, we need to transfer your Personal Data internationally. In particular, Personal Data collected by us in the EEA and UK may be transferred to and processed in countries outside the European Economic Area ("EEA"). Those countries may not have the same level of protection for Personal Data as in the EEA.

Where we transfer your data outside of the EEA we have in place the Standard Contractual Clauses adopted by the European Commission for the transfer of personal data. You can obtain a copy by making a request using the contact details below.

 

  1. HOW LONG WE KEEP YOUR INFORMATION

We keep the personal information that we obtain about you during the recruitment process for no longer than is necessary for the purpose for which it is processed (or for unsuccessful candidates where specific restrictions apply, within the period stated in the attached Appendix),

If your application is successful, your personal information will be transferred to the HR file system for the purposes of your hiring process and employment contract in accordance with our employment privacy policies.

  1. YOUR RIGHTS WITH RESPECT TO YOUR PERSONAL INFORMATION

In relation to the processing of your information by the Company, you have the following rights:

  • To withdraw your consent at any time. Please keep in mind that withdrawing your consent does not have retroactive effect. This means that the withdrawal does not affect the lawfulness of past processing based on consent before its withdrawal. The Company is therefore not required to undo these past processing following the withdrawal of your consent. 
  • Request access to your personal information. This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.
  • Request correction of the personal information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected.
  • Request erasure of your personal information. This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal information where you have exercised your right to withdraw consent (see above).
  • Request the restriction of processing of your personal information. This enables you to ask us to suspend the processing of personal information about you, for example if you want us to establish its accuracy or avoid the erasure of the personal data.
  • Request the transfer of your personal information to another party, i.e. the right to data portability, where you have the right to receive your personal data in a structured, commonly used and machine-readable format and have the right to transmit that data to another controller without hindrance from us.
  • The right to complain to the relevant supervisory authority.

APPENDIX – Data Retention

We keep the personal information that we obtain about you during the recruitment process for no longer than is necessary for the purpose for which it is processed, being specified that for unsuccessful applicants, this information will be erased at the latest two (2) years following the last contact or within the period stated below.
